Hi all,
I thought I'd share this with you because I thought it was interesting. Yes, it's semi related to millionaire but it's mostly about my practicing in "Legal-ese" so I thought I'd put it in Gen-discussion.
Here is the message I was sent:
Yes, this is touchy, because if this request was real and had good intentions I feel like a big idiot for telling him no. But, notice he said he worked for "American Heart Disease", which made me skeptical. Also, I'm on a short leash right now as far as copyright infringement goes, thanks to something I did in the past that was totally unrelated to Millionaire stuff. I usually just ignore such PMs but then he had another user comment on my video telling me to reply. So i did.
Here was my response:
Did I do the right thing here?

Hello,
I'm a volunteer worker with the American Heart Disease and I'm in charge of the production of a small, fun game of who wants to be a millionaire?, where there will be contestants playing for money, and donators who buy tickets to see it!
I was just wondering if I could use your .swf for the latest Millionaire theme, so that it'd look really nice and cool for our audiences!
It'd be really cool, and I'll definitely credit it to you, and if you'd like, send you a video of it.
Thanks!

Whereas there is no such organization as "American Heart Disease";
Whereas, even if you are a volunteer for the American Heart Association ("AHA"), you are not an official representative of the AHA, and do not have any legal agreement with, or authorization from, ABC DOMESTIC TELEVISION to use music from their game and software based on their game and bearing their trademark(s) for monetary gains or public exhibition;
Whereas you'd make no notable profits from the game if contestants were playing for the money that people paid for in tickets;
Whereas the game is not complete;
Whereas the very few times I distributed this game to people who requested it because they were doing it for a "charity", I got royally screwed;
I feel I am both legally and personally obligated and motivated to deny your request.
I apologize for any inconvenience this may cause you.
